Terms and Conditions
1. If you book for another person or persons you are confirming that you have the authority to accept these booking conditions on their behalf.
2. When you book with Charterscene in Australia or pay a deposit you are making a contract with Charterscene to be construed under the laws of New South Wales.
3. Information given by you in a booking form online and by Charterscene in an acceptance email forms part of our contract.
4. Charterscene reserves the right to make such changes to the advertised programme as are necessary due to unavoidable circumstances.
BOOKINGS
5. Tentative reservations will be held in good faith for up to 1 week pending payment of a deposit, or until another party wants to book the same vessel, whichever is sooner. The booking is not secured until a deposit has been received
When the fees are $1,000 or less you must pay in full. For fees over $1,000 a deposit of 50% of the total fee is required to secure the booking.
6. A cruise will be confirmed on receipt of the deposit and acceptance of these Terms and Conditions. All bookings made within 14 days of cruise date require payment in full at the time of booking.
CANCELLATIONS AND REFUNDS
7. If you request a cruise cancellation, which is 60 days or more prior to the cruise date, a 10% administration fee (ie 10% of the full Charter Fee) will apply. Cancellation requests, which are received less than 60 days, but more than 7 days prior to the Event date, will be subject to a 50% fee. (That is, the 50% deposit paid will be forfeited). The full cruise fee, including catering and pick up fees, will be charged where cancellation takes place within 7 days of the cruise date.
8. If you cancel a booking made by a discount pre-paid voucher no refund is available.
9. Charterscene may substitute another Vessel for the original Vessel contracted, and shall not incur any penalty, provided the Vessel satisfactorily provides the original services contracted
10. In the unlikely event of a cancellation by Charterscene a full refund will be made and Charterscene will not be liable for any consequential loss or damage.
INSURANCE AND INDEMNITY
11. You are recommended to take out insurance to cover cancellation due to medical or other unavoidable causes.
12. You agree to comply with Charterscene operating procedures issued for your tour, charter or event.
13. Charterscene excludes liability for death or physical or mental injury to the customer howsoever caused arising from or in connection with the delivery of services under this agreement.
14. The customer indemnifies Charterscene against all claims and liabilities arising from the death or physical or mental injury to the customer howsoever caused arising from or in connection with the delivery of services under this agreement.
15. The customer acknowledges and accepts that boating activities carry inherent risks such as those arising from physical exertion, slips and falls, adverse weather conditions, equipment failure, remoteness from medical services.
